Welcome to Notedfy. The terms “we”, “us” and “our” refer to Notedfy. We operate this website and store, including all related content, features, products and services (the Services). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced here, govern your use of the Services. By accessing or using our Services, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

Access and account

You must be at least the age of majority in your place of residence to use the Services. You are responsible for ensuring that any information you provide is accurate and up to date. You are responsible for all activity under your account and must keep your account details secure. Accounts may not be transferred or sold.

Products

We make reasonable efforts to display our products accurately. Colours and appearance may vary depending on your device and settings. Product descriptions and availability may change without notice. We reserve the right to limit quantities or discontinue products at any time.

Founders Edition lifetime discount

Customers who purchase the Founders Edition receive a lifetime 10% discount on future Notedfy products. This discount is tied to the original purchasing account and email address, is non-transferable, and may not be resold or shared.

The lifetime discount applies to full-price products only and may not be combined with other promotions, discounts, bundles, or sale pricing unless otherwise stated.

We reserve the right to modify or discontinue the lifetime discount for any individual account found to be abusing the discount or using it in bad faith, including but not limited to reselling, bulk purchasing for commercial use, or account sharing.

The lifetime discount does not apply to shipping, taxes, duties, or third-party products.

Orders

By placing an order, you are making an offer to purchase. Orders are not accepted until confirmed by us. Payment must be received before an order is accepted.

Presale orders are subject to manufacturing and logistics timelines. Estimated delivery dates are provided at checkout but are not guaranteed. We may cancel or refuse orders at our discretion and will notify you if this occurs.

Returns are governed by our Returns Policy.

Purchases are for personal use only and not for resale.

Prices and billing

Prices are shown at checkout and may change without notice. Prices do not include shipping, duties, or taxes unless stated. You agree to provide accurate billing information and authorise us to charge your payment method for your order.

Shipping and delivery

Delivery times are estimates only. We are not responsible for delays caused by carriers, customs, or events outside our control. Risk of loss passes to you once your order is handed to the carrier.

All content on this site is owned by Notedfy or its licensors and protected by intellectual property laws. You may use the Services for personal, non-commercial purposes only. You may not copy, reproduce, distribute, or use any content without written permission.

Relationship with Shopify

Notedfy is powered by Shopify, which enables us to provide the Services to you. Any purchases you make are made directly with Notedfy. Shopify is not responsible for any aspect of transactions between you and Notedfy. You release Shopify and its affiliates from claims arising from purchases made through our store.

Privacy

Your use of the Services is subject to our Privacy Policy [LINK] and Shopify’s Privacy Policy. By using the Services, you acknowledge that your data may be processed by Shopify and service providers to deliver the Services.

Feedback

If you submit feedback or content, you grant us a perpetual, royalty-free licence to use it for business and marketing purposes. You confirm you have the rights to any feedback you submit.

Errors

We may correct errors in product descriptions, pricing, or availability and cancel orders if information is inaccurate.

Prohibited use

You may not misuse the Services, violate laws, infringe intellectual property, distribute malware, scrape content, or interfere with the operation of the site. We may suspend or terminate access for violations.

Termination

We may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance of the updated Terms.

Mobile Terms of Service

The Notedfy mobile message service (the “Service”) is operated by Notedfy (“Notedfy”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Notedfy’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Notedfy through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Notedfy. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to Notedfy or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Notedfy mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
